Terms of Use

These terms are an agreement between you and Forty Seven and Trade LLC, a Wyoming limited liability company (“we”, “us”), about the Felty app for iPad (“Felty”, “the app”). By downloading or using Felty you agree to these terms. If you do not agree, please do not use the app.

1. Who can use Felty

Felty is intended for users aged 13 and older. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. Your license

We give you a personal, non-exclusive, non-transferable license to use Felty on Apple devices you own or control, as allowed by the App Store Terms of Service. The pictures, designs, software and the Felty name belong to us or our licensors. You may keep, save and share the pictures you color for personal, non-commercial purposes. You may not copy, sell or redistribute the app or its picture library, or reverse engineer the app, except where the law allows it.

3. Your account

Felty creates a guest account for you automatically. You can also sign in with Apple to use your account and purchases on all your devices. You can sign out or delete your account in the app’s Settings at any time. Our Privacy Policy explains what data we keep and how to delete it.

4. Felty+

• What it is. Felty+ is a one-time, in-app purchase. It is not a subscription and does not renew.
• Price. The price is shown in the app before you buy. For example, it is US$14.99 in the United States and 799 ₽ in Russia. Prices in other countries are set through the App Store and may include taxes.
• What you get. Felty+ removes ads and makes hints free. Felty+ includes the features described in the app at the time of purchase. We may add new features to Felty+, but we do not promise to.
• Payment. Payment is charged to your Apple ID by Apple when you confirm the purchase. The App Store terms apply to it.
• Restoring. Felty+ is tied to the Apple ID you used to buy it. On a new device, or after reinstalling the app, tap Restore Purchases in the app’s Settings.
• Refunds. Refunds are handled by Apple under its policies. Request one at reportaproblem.apple.com. If Apple refunds your purchase, Felty+ is removed.
• Lifetime. “Lifetime” means for as long as we offer Felty and it is available in the App Store, on devices that support it.

5. Ads

The free version of Felty shows ads from third parties, including optional ads you can watch to get a hint. We are not responsible for the content of ads or for the products and websites they link to. See the Privacy Policy for how ads use data and how to limit it.

6. Acceptable use

Do not misuse Felty: do not interfere with our servers, try to get Felty+ without paying, access other people’s accounts, or use the app in violation of the law.

7. Changes to the app

We may update Felty, add or remove pictures and features, or stop offering the app. We may suspend accounts that break these terms.

8. Disclaimer

Felty is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise that the app will be uninterrupted or error-free.

9. Limitation of liability

To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data or profits, arising from your use of Felty. Our total liability for any claim is limited to the amount you paid us for Felty in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

10. Apple

These terms are between you and us, not Apple. Apple is not responsible for Felty or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes someone’s intellectual property; we are responsible for those to the extent these terms say so. You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, unless the law of the country where you live requires otherwise.

12. Changes to these terms

We may update these terms. We will post the new version here and update the date above. If you keep using Felty after a change, you accept the new terms.
